Living Trust

When you have a reverse mortgage, there are certain steps that must be completed for a property to be transferred to a living trust. Your servicer must review and approve any request to ensure it meets state law and investor guidelines.

For the trust to be approved, the following guidelines must be met: 
  • The trust must be a living trust that is valid and enforceable
  • The primary beneficiaries of the trust must be the same individuals listed on the original mortgage and the only parties eligible for benefits from the trust
  • Contingent beneficiaries are acceptable if they do not receive benefits from the trust or have any control over the trust assets until all primary beneficiaries are deceased
  • You must notify us of any subsequent changes to the occupancy status or change of title
To request to transfer the property into a living trust, you will need to send us a copy of the executed trust agreement, including all pages, amendments and schedules. If the transfer has already been completed, a copy of the executed and recorded Warranty Deed is required.
